The Ministry of Justice submitted for public discussion the drafts on amending the Law on "Diplomatic Service" and amending and amending the Law on "Public Service".
The law "On Diplomatic Service" is proposed to be drawn up in a new edition. For example, taking into account that in some countries there is a need to create a diplomatic office instead of an embassy, and due to the lack of necessary legal regulations in the law, it is not possible to carry out this process, it is proposed to establish that with the agreement reached with the foreign state, under the general leadership of the ambassador accredited to the foreign state, a diplomatic office can operate if necessary, which will be established and dissolved by the decision of the Prime Minister, based on the agreement reached in advance between the Republic of Armenia and the given foreign state. The terms of office of ambassadors and permanent representatives (diplomatic representatives) are being reviewed.
In order to ensure the effectiveness of the work of diplomatic representatives, it is proposed to set the maximum term of office of the latter at 5 years.
At the same time, it is established that in case of appointment to a position in another state or international organization immediately after the end of the term of office, the total sum of two consecutive terms of office cannot exceed 8 years. At the same time, the deadlines for registering diplomats in the personnel reserve were specified, and in order to organize the rotation process effectively, it was necessary to review the requirement for a diplomat to work at the Ministry of Foreign Affairs or a subordinate body for at least two years, setting it at eighteen months.
A separate provision has been made regarding the terms of rotation of the consul general based on the nature of the latter's work. Taking into account that the work of the consul general requires the need to work for a longer period in a foreign country, it is recommended that when appointed to the position of consul general, the rotation in the Ministry of Foreign Affairs or a subordinate body should be carried out for at least one year, and then in the diplomatic service body of the Republic of Armenia in a foreign country, on the principle of serving for a period of three years, which can be extended for a maximum period of one year if necessary.
The provision of paying 50 percent of the compensation to the spouse holding a lower position in the case of the service of diplomat spouses in the same diplomatic service body, existing in the current law, has been removed, because it contradicts the principles of ensuring a basic salary commensurate with the duties and responsibilities of persons occupying public positions and public service positions, as well as adequate remuneration for equivalent work, provided for in Article 4 of the Law "On Remuneration of Persons Occupying State Positions and State Service Positions".
In addition, in case of service of diplomat spouses in the same diplomatic service body, the state already compensates for one apartment, saving the compensation for the second apartment.
It is planned to reorganize the diplomatic school into a diplomatic academy, taking into account the wide range of functions given to the school. A number of other changes are also proposed.
