On August 17, 2026, the prosecutor handed over to the Anti-Corruption Court the materials of the criminal proceedings against MH, accused of accepting bribes and inciting to commit official fraud, SK, accused of aiding and abusing official powers and committing official fraud, and LN, accused of abusing official powers, with a confirmed indictment.
In the criminal proceedings initiated by the Anti-Corruption Committee, it was found that M.H., from January 17 to December 31, 2019, held the position of coordinator of transactions related to real estate of Abovyan municipality and, having the authority to act on behalf of the municipality, as well as perform administrative and economic functions, in April 2019 reached an agreement with G.G., a resident of Abovyan city. About organizing the process of illegally legalizing the voluntary buildings built by GG's mother on the plot of land adjacent to address No. 3/1/1 of the 3rd microdistrict, owned by the Abovyan community, and later expropriating the plot occupied by them.
For this purpose, on April 23, 2019, G.G. appealed to V.G., the head of the Abovyan community. During the discussion of the application, MH pushed the head of the town planning department of the municipality S.K. to draw up an urban planning conclusion that does not correspond to reality. According to the false conclusion drawn up by S. Kh. on May 7, 2019, it was stated that the buildings with an area of 286.55 and 28.8 square meters located at No. 3/1/1 of the 3rd micro-district of Abovyan city were not built on the plot of land included in the list of restrictions defined by Article 60 of the Land Code. Meanwhile, the investigation revealed that the 1045.7 square meter plot of land occupied by the mentioned buildings, according to the Abovyan community's master plan, had the operational meaning of "parks, groves" and was included in the list of restrictions defined by Article 60 of the Land Code.
On the basis of the mentioned false conclusion, V.G., who held the position of head of the Abovyan community, using his official and official powers contrary to the state and official interests, on May 16, 2019, by decision N 468, illegally legalized the mentioned voluntary structures.
Then, MH submitted the relevant documents to the Abovyan service office of the staff of the State Real Estate Cadastre Committee under the Government, in order to ensure the state registration of the property rights of the community. As a result, on June 4, 2019, the property right of the Abovyan community was registered for the mentioned building and plot. On the same day, GG gave a bribe of 200 USD to MH to complete the execution of illegal activities for his benefit and to facilitate the process of expropriating the land occupied by the buildings in the name of his mother.
As a result of the report presented by S.Kh. and corresponding administrative actions, on June 5, 2019, L.N., acting as the head of the Abovyan community, made the decision N 565 regarding the direct sale of the 1045.7 square meter plot of land owned by the community for 8 million 485 thousand drams to G.G.'s mother.
Later, on December 7, 2020, on the basis of the contract of sale, the said plot of land, which is non-alienable land under Article 60 of the Land Code and has the operational meaning of "parks", was illegally expropriated and registered in the Cadastre Committee in the name of GG's mother.
On July 30, 2026, the prosecutor initiated public criminal prosecutions against MH for accepting bribes and inciting to commit official fraud, against S.Kh. for aiding and abetting the abuse of official powers and committing official fraud, and against LN for abusing official powers.
