Regarding the case, as a result of the investigation and operational actions taken by the investigators in the framework of the criminal proceedings initiated by the Vagharshapat investigative department of the Armavir Regional Investigation Department of the RA Investigative Committee, the circumstances of the incident, including the motive, the identity of the two persons who committed the alleged crime, who are residents of the same village, were found out. by the evidentiary actions carried out by are unfriendly relations.
The investigation revealed that a 43-year-old fellow villager of the victim learned that the victim and one of his sons had an argument and hit his son. For this purpose, the 43-year-old man, with his illegally kept firearm, shot his friend at around 5:30 p.m. on the same day. sat back in the driver's seat of his Opel Astra G car, while his friend drove the car along the central street of the village.
Noticing the car of one of the victim's sons driving in the opposite lane in a busy area, in a dangerous way for other people's lives, ignoring the presence of residential houses in the vicinity, the 43-year-old man fired about five shots from the interior of the car in the direction of the victim's son's car, but the shots did not hit the target. , as a result of which, due to circumstances beyond his control, he could not complete the crime.
However, intending to complete the criminal intention, he continued driving with the aforementioned friend, parked the car in front of Amberdi secondary school.
Noticing there the "Opel Zafira" car driven by AB driving in his direction, again not taking into account the presence of an educational institution and residential houses in the vicinity, in the middle of the school and houses, in a dangerous way for the lives of other people, with the aim of illegally depriving a fellow villager of his life. fired about seven shots at the latter with the same firearm, causing non-life-threatening gunshot wounds.
During that time, the friend, continuing to assist the 43-year-old person, drove and parked the car nearby, in front of the school, and waited for the friend in order to make his escape from the scene unhindered immediately after carrying out the latter's criminal intent.
Immediately after the incident, the 43-year-old person, sitting in a car owned by him, but driven by a friend, fled from the scene, and in order to hide the car, he moved it, parked it in a field near the irrigation water aqueduct in Armavir region, and fled. Sufficient facts obtained. based on this, a 43-year-old man was charged under Article 335, Part 1 of the RA Criminal Code.
