A number of circumstances of the damage caused to the state by the company's activities, including the amount of the damage, as well as the embezzlement mechanism, were revealed by the actions carried out within the framework of the criminal proceedings being investigated in the fifth department of the Main Department of Economic Crimes and Smuggling of the RA Investigative Committee.
In particular, according to the preliminary investigation of the criminal proceedings initiated by Article 290, Part 3, Clause 2 of the RA Criminal Code, it was found that the SP company engaged in the production of dairy products, import of milk powder and wholesale sales did not pay particularly large amounts of taxes to the state budget.
During the preliminary investigation of the criminal proceedings, as a result of the measures undertaken jointly with the employees of the RA National Security Service and the RA SRC Operative Intelligence Department, as well as a number of evidentiary and procedural actions, it was established that the company had under-declared the sales turnover, in the calculations-reports submitted to the tax authority, distorted data not corresponding to the real volumes, as a result of which the state suffered a particularly large loss of AMD 304,000,000.
Based on the facts obtained during the preliminary investigation, decisions were made against the founder-director of the company and the person who is the authorized user and user of the electronic system for submitting reports of the tax authority, who holds the position of treasurer in the company, under Article 290, Part 3, 1 and 2 of the RA Criminal Code. According to the decision of the court, arrest was applied to the founder-director of the company as a measure of restraint.
The investigation is ongoing. In order to clarify the final amount of the damage caused to the state, the necessary evidentiary and procedural actions arising from the proceedings are being carried out.
