We inform you that the Appellate Criminal Court in 2024 rejected the appeal against the decision to extend the detention of businessman Karen Hakobyan, who has been in illegal detention since September 20, but the court's decision has not yet been handed over to the defense side.
It is noteworthy that the oral examination of the complaint was carried out in the Criminal Court of Appeal and the final part of the decision was published on 07.01.2025, and on 08.01.2025. Judge Artur Nahapetyan's powers were terminated and the latter was appointed deputy chairman of the RA Investigative Committee.
It turns out that the judge who made the decision is already working as the Deputy Chairman of the RA Investigative Committee, but has not yet provided the legal document to the defense (according to the former judge's staff, due to lack of readiness).
It is obvious that even in the conditions of the rejection of the complaint, the Court can record a new position that is in the interests of the defense side, the opposite is not possible to the extent that no complaint was filed by the Prosecutor's Office.
The appeal against the decision to extend the detention of Karen Hakobyan, a businessman who was not released before and was abused, which was submitted back in 2024. on November 21, it was examined in the Appellate Criminal Court for almost a month and a half, in fact grossly violating not only personal freedom, but also Karen Hakobyan's right to a fair trial.
First, the publication of the decision was scheduled for 2024. on December 19, then it was postponed to 2024. On December 30, after that, the Court made a decision to carry out the examination of the complaint through an oral procedure, which was first set for 2025. on January 9, then moved to January 7 of this year.
The decision to proceed to the oral procedure was justified by the Court's need to find out additional circumstances, but during the court session the Court did not try to find out any "additional" circumstances.
For the defense side, the real reason for these delays became clear already after receiving the information about the appointment of former judge Artur Nahapetyan to a new position. Let's remind that businessman Karen Hakobyan, who has never been convicted before, is accused of laundering large amounts of money, but there is no evidence at the basis of the accusation and it is based solely on assumptions and hypotheses.
