Investigations of two separate criminal proceedings initiated in connection with the cases of abuses in "Karen Demirchyan's Yerevan Metropolite" PB company have been completed in the main department of the Investigation Committee of the RA Investigative Committee.
It should be noted that the criminal manifestations refer to different periods, on which proceedings were initiated in different investigative bodies of the RA, under different articles of the Criminal Code of the RA, which later, in order to ensure an objective and comprehensive investigation, were combined into one proceeding.
During the preliminary investigation of the criminal proceedings, it was proved that the director of the "Karen Demirchyan Yerevan Metro" PB company P.Y. from March to 2019 during the period of May, with the initial intention of stealing the particularly large property of "Karen Demirchyan Yerevan Metro" CJSC entrusted to him by using his official position in a wasteful way, for his son, who held the positions of the deputy head of the "Communication and Signaling" branch of the metro, and then the head of the same branch, incomparable to the market in June 2013, directors of the Yerevan Metro, in order to acquire at a cheap price at the regular meeting of the board, proposed to expropriate the 944.5 square meter basement floor of building 76 Baghramyan Avenue, Yerevan, which is on the balance sheet of the company and has been used for the needs of the CJSC for years, receiving the consent of the board of directors.
In the conditions of the above, on the basis of false documents and justifications, the area was submitted for expropriation through public auctions, the specialist-appraiser of the "State Property Inventory and Valuation Agency" SNOC prepared an obviously false document, an evaluation report, according to which the market value of the area in 2013 As of October, it is AMD 106,850,050, while its real market value is twice as high as AMD 194,880,000. P.Y.'s son, taking advantage of the rule defined in the classical auction procedure, that if it is not sold at auction, its starting price decreases, he deliberately did not submit an application for participation in the first and second auctions held and only during the third auction he bought the mentioned real estate for AMD 75,393,360.
Continuing his criminal activities, the director of the metro, PY, having reached a preliminary agreement with his son, decided to rob CJSC's 60 sq.m. In order to realize their intention, in July 2014, the director of the metro and his son signed a lease of 60 square meters of the area of the basement floor already owned by the latter. contract on leasing the area to CJSC for a period of 25 years, setting AMD 120,000 as one month's rent without justification.
As a result, until March 2020, CJSC funds were transferred to the director's son in particularly large amounts, a total of AMD 7,104,000. In addition, P.Y. was transferred to the son's friend, "Communication and Signaling", a person related to him. with the assistance of chief engineer of the branch A.S. in order to carry out the works of replacement with sets, he announced a formal tender, in which, according to the pre-arranged agreement, only the private limited company created by A.S. participated, presenting a price of AMD 57,000,000, which is four times more expensive than the market price. offer.
PY, guided by his relationship with A.S., without further investigation of the validity of the submitted price offer, without taking into account the fact that the subject who won the tender has never carried out any activity, confirmed the fact of recognizing him as the winner based on the price offered in the tender. , on the basis of which a purchase contract for the performance of works worth 57,000,000 AMD was signed between the metro and the private company.
Having no employees registered in the company, AS involved the employees of the metro in the execution of the works provided by the mentioned contract.
In October 2013, after completing the works provided for in the contract, the parties signed a handover-acceptance protocol, on the basis of which RA 57,000,000 was transferred from the metro bank account to the private bank account opened by A.S. drams in the event that the metro could spend only 12,495,000 for the purchase of the mentioned works and products AMD: AMD
In addition, it was found that in 2016-2019 During this time, the person holding the position of assistant to the mayor of Yerevan, and then the deputy secretary of the staff of the Yerevan Municipality, not having a service car assigned to him in the prescribed manner, offered three of his acquaintances 2012-2018. during successive periods, he formally accepted a job in the metro operating under Yerevan Municipality, but actually served himself and his family members.
At the request of the mentioned official, PY, using his official position, employed the mentioned persons as drivers, who did not actually work in CJSC, but instead, with the knowledge and permission of the director, for years as drivers, with cars on the balance sheet of the metro. , served the aforementioned official of the municipality and his family members, as a result of which, during the specified period, the budget of the metro, in the form of salary and vehicle operation and fuel costs, was unjustified. was issued in particularly large amounts, a total of 28,099,506 AMD.
In addition, PY, with the assistance of the manager of metro affairs and the person engaged in the distribution of gasoline on his assignment, 2009-2019. in the period between, by making different amounts of additions, from the gasoline purchased for the needs of the metro, in different batches every month, out of personal and group interests, in a wasteful way, he embezzled a particularly large amount of 39,963,327.6 AMD, a total of 110,010 liters of gasoline, using them for other purposes. In addition, the metro director of the administrative apparatus of the company hired two persons in the legal contract department and in the overhaul route of the company's technological economic trains, who, with the knowledge and permission of the director, did not attend work and did not perform their work duties, but received a salary from the company's budget every month, as a result of which, in one case, a total of 7.120 .436, in the case of the second - AMD 4,084,874 salary. In addition, at the suggestion of P.Y. 2016 In May, on the website of the European Bank for Reconstruction and Development, an announcement of the tender for capital repair and modernization of two head cars of the metro "81-717" type was published, in which the Russian company offering 550,000 euros was recognized as the winner, however, the contract between the metro and the mentioned Russian company was not 550,000 euros. other: a contract of 1.100.000 EUR, planning to modernize and to overhaul 4 head cars belonging to the metro, the execution works of which were completed in December 2016, and a handover-acceptance act was signed between the director of the metro, P.Y., and the director of the Russian company.
Then P.Y., in violation of the mandatory requirement to hold a tender for the purchase in case of exceeding one million AMD established by the Law of the Republic of Armenia "On Purchases", without announcing and holding a tender, in 2017. in August, on behalf of the metro, as a customer, signed a general contract for the overhaul and modernization of four carriages worth 1,320,000 euros with the Armenian branch of the mentioned Russian company with an inflated price of 220,000 euros from the previous contract, which was not justified in any way.
As a result, the repair of the mentioned four carriages, according to PY, was carried out by the mentioned Russian company at the subway wagon assembly station, actually completing it in December 2017, but according to the instructions of PY, the documents and handover-acceptance regarding the overhaul of two of the four mentioned carriages the acts were drawn up in 2017, and the other two in 2018. A total of 1,320,000 euros was transferred by the Yerevan Metro to the company carrying out the renovation, thereby stealing from the CJSC's budget a particularly large sum of 220,000 euros, equivalent to 122,810,600 AMD. Another criminal episode was revealed during the preliminary investigation of the criminal proceedings.
In particular, on December 11, 2019, information was received that according to the contract signed on September 5, 2019 and the handover-acceptance protocol on November 11 of the same year for the needs of the "Karen Demirchyan Metro" PB company, the supplier SP company 2019 On November 8, 2008, the central warehouse at 87 Araratyan St., Yerevan Metro, delivered 4 metro cars. electric pneumatic which have been accepted by the relevant employees.
Later, however, it was found that the electric pneumatic motors received were not new and did not meet the terms of the contract.
On the basis of the obtained sufficient facts, the director of the metro was charged under Article 256, Part 3, Clause 3 (Section 7) and Article 256, Part 2, Clauses 2 and 3 of the RA Criminal Code, the latter's son Section 2: Article 46-256, Part 3, Clause 3 of the RA Criminal Code, real estate appraiser: Article 46-256, Part 3, Clause 3 and Article 457, Part 1, to an official of the municipality, an employee of the PB company, the private director, and the person appointed to the position of the deputy head of the legal department, according to Article 46-256, Part 3, Clause 3 of the RA Criminal Code, and to the director of the SP company supplying pneumatics, according to Article 255 of the RA Criminal Code According to clause 3 of part 3.
