The Ministry of Economy proposes to make additions to the Law "On Food Safety". The Ministry presented a legislative package for public discussion. From March 16, 2025, the Republic of Armenia has officially received permission to export aquaculture - scaly fish and their products to European Union countries. According to European Commission regulations, fish and fish product exporters must apply for registration in the European Union's Trade and Control Professional System (TRACES) if they meet EU standards. Currently, several companies have shown interest in exporting to European Union countries.
According to Article 6, Part 2 of the Constitution, on the basis of the Constitution and laws and in order to ensure their implementation, the bodies provided for by the Constitution may be authorized by law to adopt sub-legislative normative legal acts. The enabling norms must comply with the principle of legal certainty, as well as the requirements defined by the regulations adopted by the European Commission must go through a certain implementation process in order to become an integral part of the domestic legislation.
In this context, in order to be able to define the procedure for the export of fish and fish products from the Republic of Armenia to the countries of the European Union in the drafts of the government's decision and for the purpose of the export of fish and fish products from the Republic of Armenia to the countries of the European Union, the approval of the requirements submitted to fish farms and fish product production organizations in accordance with the EU regulations and the implementation of inspections, it is necessary to make an addition to Article 6 of the law by defining the relevant authorizing norms, as well as based on the fact that production is an economic activity, then the conditions and procedure for exercising the right of the latter are defined by law, so it is necessary to establish parallel provisions in the law "On State Control of Food Safety".
Considering the importance and urgency of the issue, it will provide a new opportunity for producers to diversify into new markets, it is suggested to consider the package of projects as urgent and urgent.
After the adoption of the draft laws, it will be possible to develop and submit to the approval of the government a set of relevant draft decisions, by which the requirements of the European Union regulations will be localized in the national legislation, which will be a guarantee for the export of fish and fish products to the countries of the European Union, in the context of the fulfillment of international obligations.
